These Terms of Service ("Terms") govern your use of PhoneVerifier.io operated by DataSource0 LLC ("we," "our," or "us"). By accessing or using our service, you agree to be bound by these Terms.

1. Description of Service

PhoneVerifier.io provides phone number verification services. Users upload lists of phone numbers, and we return verification results including line type, carrier information, and validity status.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By using our service, you represent that you meet these requirements.

3. Account and Access

Access to certain features may require authentication. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Acceptable Use

You agree to use our service only for lawful purposes. You must NOT:

• Upload data you do not have the right to use or share
• Use the service for any illegal purpose, including violations of TCPA, GDPR, or other applicable laws
• Use verified phone numbers for unsolicited marketing, spam, or harassment
• Attempt to circumvent security measures or access systems without authorization
• Resell or redistribute verification results without authorization
• Upload malicious files or attempt to disrupt our systems
• Use the service to facilitate fraud, identity theft, or illegal telemarketing

5. Data Rights and Responsibilities

You represent and warrant that:

• You have all necessary rights to upload and process the phone number data you submit
• Your use of our service complies with all applicable privacy and telecommunications laws
• You will not use verification results in violation of any laws, including the Telephone Consumer Protection Act (TCPA)

You retain ownership of your uploaded data. We claim no ownership rights over your data.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the service at any time with reasonable notice when possible.

7. Accuracy of Results

While we strive for accuracy, verification results are provided "as is" based on available data sources. We do not guarantee 100% accuracy and recommend using results as one factor in your decision-making process.

Verification results are dependent on the accuracy and completeness of third-party data sources used for comparison. No verification source is 100% accurate. Phone connectivity status changes frequently, and verification results represent a point-in-time snapshot that may not reflect current or future status.

8. Provider Comparison Methodology

Our service may display comparisons between data providers based on verification results. These comparisons are generated using the following methodology:

• Objective Measurement: All providers are evaluated using identical, standardized criteria applied uniformly
• Multi-Weight Analysis: Quality rankings are derived from sensitivity analysis across 35 different weighting methodologies, measuring exact position match rate, best phone presence rate, and data freshness. Published scores represent average performance across all tested weight combinations
• Statistical Indicators: Standard deviation indicates ranking stability—providers with lower deviation rank consistently regardless of methodology chosen
• Sample-Based: Provider statistics are based on available sample data uploaded by users. Results from providers with fewer analyzed records may be less statistically representative
• Point-in-Time: Results reflect data quality at the time of verification and may not represent current or future provider performance

Provider comparisons and quality scores do not constitute endorsements, criticisms, or recommendations for or against any provider. Rankings reflect measured performance against verification criteria only. Individual results may vary based on data type, geography, property type, list age, and other factors.

No single weighting scheme is favored; results reflect aggregate performance across multiple reasonable interpretations of data quality.

9. Limitation of Use for Provider Comparisons

Provider comparison data is intended to help users evaluate data quality as one factor in their decision-making process. It should not be the sole basis for business decisions regarding data providers. Users are encouraged to conduct independent due diligence, including testing their own data samples, before making provider selection decisions.

10. Provider Feedback and Dispute Resolution

Data providers may submit feedback regarding verification results by contacting feedback@phoneverifier.io. We will review submissions in good faith; however:

• We retain sole and absolute discretion over our methodology, scoring calculations, weight combinations, and published results
• Submission of feedback does not obligate us to modify, remove, or amend any results, rankings, or methodology
• We are under no obligation to respond to feedback within any specific timeframe
• Feedback review does not constitute an admission of error or inaccuracy

By uploading data identified as originating from a specific provider, users acknowledge that resulting verification scores and comparisons are generated through our proprietary methodology and may be published or displayed within our platform.

11. Proprietary Methodology and Trade Secrets

Our verification methodology, scoring algorithms, weight combinations, data processing techniques, and comparative analysis methods constitute proprietary trade secrets of DataSource0 LLC. We reserve the right to:

• Withhold detailed algorithmic specifications, source code, and internal calculation methods
• Decline requests to disclose specific data fields, weights, or formulas used in scoring
• Modify our methodology at any time without prior notice or disclosure of changes
• Use aggregate, anonymized, or derived data for internal analysis, product improvement, and benchmarking purposes

Nothing in these Terms or in our published methodology descriptions shall be construed as a waiver of trade secret protection or an obligation to disclose proprietary information.

12. Third-Party Data Sources and Restrictions

Our verification service utilizes third-party data sources that may be subject to usage restrictions, licensing limitations, or confidentiality obligations. Accordingly:

• We are not obligated to disclose the identity of third-party data providers or the specific data fields obtained from such sources
• Published results reflect derived metrics and comparative analyses, not raw third-party data
• Users may not attempt to reverse-engineer, extract, or identify underlying third-party data from our verification results
• Third-party data restrictions may limit the granularity or specificity of information we can provide upon request

13. Waiver of Claims Related to Results

By using our service or uploading data for verification, you acknowledge and agree that:

• Verification results, quality scores, and provider comparisons are generated through objective, standardized methodology
• Unfavorable results do not constitute defamation, trade libel, tortious interference, or any other actionable claim
• You waive any right to bring claims based on the accuracy, publication, or display of verification results
• Rankings and comparisons reflect measured performance and do not constitute opinions about business practices, capabilities, or reputation

14. Payment Terms

If applicable, fees for our service will be communicated before processing. All fees are non-refundable unless otherwise specified. We reserve the right to change pricing with notice.

15. Intellectual Property

Our service, including its design, features, and content (excluding your uploaded data), is owned by DataSource0 LLC and protected by intellectual property laws. You may not copy, modify, or reverse engineer our service.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DataSource0 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

17. Indemnification

You agree to indemnify and hold harmless DataSource0 LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any rights of a third party.

18. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

19. Termination

We may terminate or suspend your access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

21. Dispute Resolution

Any disputes arising from these Terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

22. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the service after changes constitutes acceptance of the new Terms.

23. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DataSource0 LLC regarding the use of our service.
